True Northwest Law Firm respects the privacy of everyone who visits this website. This policy explains what information we collect through the site, why we collect it, how we protect it and how long we keep it. It also explains the separate and stronger protection that applies to information given to us by clients.
01 Two different kinds of information
It is important to distinguish between two categories, because they are protected differently.
The first is information you provide through this website before any engagement exists, such as the contents of the contact form. That information is covered by this policy, but it is not privileged and it is not confidential in the legal sense, for the reasons set out in our Terms of Use. Do not send us confidential details until an engagement agreement is in place.
The second is information given to us in the course of an attorney and client relationship. That information is protected by the attorney and client privilege and by our professional duty of confidentiality, both of which are considerably stronger than anything this policy provides. That protection continues after the matter concludes and after the relationship ends.
02 Information you give us
When you complete the contact form on this website we collect the information you enter into it. That is:
- Your first and last name
- Your email address
- Your telephone number, where you provide one
- The area of law you select, where you select one
- Your preferred method of contact
- The description of your matter that you write
03 Information collected automatically
Like most websites, this site and the server hosting it may record certain technical information automatically when you visit. That may include your internet protocol address, the type and version of your browser, your operating system, the pages you view, the time and date of your visit and the site you arrived from.
This information is used to operate and secure the website and to understand in general terms how it is used. It is not used to identify you personally, and we do not attempt to combine it with the information you submit through the contact form.
04 How we use your information
We use the information you provide through the contact form for one purpose: to respond to your enquiry and, where appropriate, to assess whether the firm is able to act for you.
That assessment includes a conflicts check, in which we determine whether we already represent a party whose interests are adverse to yours. Conducting that check is a professional obligation and it is the reason we ask for names.
We do not sell your information. We do not rent, trade or otherwise make it available to any third party for their own marketing purposes. We will not add you to a mailing list on the strength of a contact form submission.
05 When we may disclose information
We disclose personal information only in the following circumstances:
- To attorneys and staff within the firm who need it in order to respond to your enquiry or to conduct the conflicts check
- To service providers who host our website or provide our electronic mail, who are permitted to process it only on our instructions
- Where we are required to do so by law, by court order or by a regulatory authority with jurisdiction over the firm
- Where disclosure is necessary to establish or defend a legal claim, or to prevent harm
- With your consent
06 Security of electronic mail
Electronic mail sent over the internet is not a secure medium. It can be intercepted, delayed, corrupted or delivered to the wrong recipient, and no website form can alter that.
We take reasonable technical and organisational measures to protect the information we hold, including restricting access to those who need it. No system, however, can be guaranteed absolutely secure, and we cannot warrant the security of information while it is in transit to us.
Where a matter is particularly sensitive, telephone the office rather than sending detail electronically, and we will agree a more appropriate method.
08 How long we keep information
Enquiries that do not result in an engagement are retained for a limited period, sufficient to allow us to identify a future conflict of interest, and are then deleted.
Client files are retained for the period required by the rules of professional conduct applicable to Missouri attorneys and by any other law that applies, after which they are destroyed securely.
09 Your choices
You may ask us what personal information we hold about you, ask us to correct it if it is inaccurate, or ask us to delete it.
We will comply with such a request unless we are required to retain the information by law or by the rules of professional conduct, or unless it forms part of a client file we are obliged to preserve. Where we cannot comply in full we will tell you why.
To make a request, write to us at the address at the foot of this page.
10 Children
This website is directed to adults. It is not intended for children and we do not knowingly collect personal information from a child through it.
If you believe a child has submitted information to us through this site, please tell us and we will delete it.
11 Links to other sites
This website may link to sites operated by others. We do not control those sites and this policy does not apply to them.
If you follow a link away from this site, read the privacy policy of the site you arrive at before providing it with any information.
12 Changes to this policy
We may amend this policy from time to time by publishing a revised version on this page. The date at the head of this document records when it was last revised.
Where a change is significant we will take reasonable steps to bring it to the attention of those affected. Please check this page from time to time.
